The following Boudoir By J Anderson (BBJA) Gift Card Terms and Conditions (this “Agreement”), are subject to Boudoir By J Anderson’s Privacy Policy and Terms of Use, and describe the supplemental terms and conditions that apply to use of BBJA Gift Cards and BBJA’s Promotional Gift Cards (collectively, “BBJA’s Gift Cards” or “Gift Cards”).
By purchasing, accepting or using your Boudoir By J Anderson Gift Card, you agree to be bound by the following Agreement. If you do not agree with this Agreement, do not purchase, use or accept Boudoir By J Anderson Gift Cards. A reference to “our,” “we,” “us,” or “Card Companies” means Square. A reference to “Boudoir By J Anderson” includes The Boudoir By J Anderson Company, J Anderson Studios, LLC, The J Anderson Studios Company and each of their related, affiliated, or subsidiary companies (other than Square).

1. ABOUT YOUR BOUDOIR BY J ANDERSON GIFT CARD. Boudoir By J Anderson Gift Cards and E-Gift Cards are issued by Square. Square is authorized to issue Boudoir By J Anderson Gift Cards for sale by and redemption at Boudoir By J Anderson located in the United States. Square is also responsible for the operation and maintenance of the Boudoir By J Anderson Gift Card program in the United States. Square is the sole legal obligor to Cardholders who purchased Gift Cards in the U.S. Boudoir By J Anderson and its affiliates (other than the Square) and franchisees bear no responsibility or liability for any Boudoir By J Anderson Gift Cards, and you hereby knowingly release Boudoir By J Anderson and its affiliates (other than the Boudoir By J Anderson) and franchisees from any and all liability or claims of any nature whatsoever arising in connection with Boudoir By J Anderson Gift Cards.
Gift Cards can be purchased or reloaded online at https://squareup.com/gift/D1CXXQZ9HTBRX/order. The Gift Card is not a debit or credit card.
2. BALANCE INQUIRY. For balance inquiry, Cardholders can visit https://squareup.com/gift/D1CXXQZ9HTBRX/check-balance. The balance you hear when inquiring over the telephone is an estimate only. In most cases, the balance is adjusted immediately when you make a purchase, but there may be occasions when the balance adjustment is delayed.
3. NO EXPIRATION/FEES. Boudoir By J Anderson Gift Cards, excluding Boudoir By J Anderson Promotional Gift Cards, do not expire. No fees for inactivity or service fees apply. Boudoir By J Anderson Promotional Gift Cards expire as of the date printed on the Gift Card.
4. REQUIREMENTS. All Boudoir By J Anderson Gift Card holders must sign a legally binding photography agreement/contract with Boudoir By J Anderson, before any photography or print services will be administered. Without contract signed, gift card holder does not have the rights to any services provided by Boudoir By J Anderson and does not have the right to use the Boudoir By J Anderson Gift Card in exchange for any Boudoir By J Anderson photography or print services, or for any monetary refunds.
5. REDEMPTION. Your Boudoir By J Anderson Gift card is redeemable only for use with an experience/studio retainer, payment of invoice balances, or to purchase a la carte products and/or collections at participating Boudoir By J Anderson locations in the United States. Photography Sessions are by appointment only, subject to studio availability. It has no cash value and may not be redeemed for cash (except as required by law) or used to purchase another Boudoir By J Anderson Gift Card. The Gift Card is also not redeemable for a check or credit, nor can it be applied as payment to any credit or other account. Gift Card balances will be adjusted by an amount that reflects the local currency where the Gift Card is being redeemed based on then-current currency exchange rates, as determined by the Square in their sole discretion.
6. NO REFUNDS. No refunds are permitted with respect to Boudoir By J Anderson Gift Cards (except as required by law).
7. SESSION CANCELLATIONS AND RESCHEDULING. Boudoir By J Anderson may charge a fee for session cancellations and/or rescheduling as per the terms in your signed Photography Agreement. If applicable, said fees must be paid in full before you will be allowed to reschedule or select another session date.
8. LOST, DAMAGED, OR STOLEN GIFT CARDS. Gift cards that are lost, stolen, damaged, or used without authorization will not be replaced.
9. NO RESALE. Boudoir By J Anderson Gift Cards may not be resold by any unauthorized vendor under penalty of law. Unlawful resale or attempted resale is grounds for seizure and cancellation without compensation. We will not honor Gift Cards purchased through an unauthorized vendor, including any Internet auction sites.
10. REFUSAL OF SERVICE. Boudoir By J Anderson may refuse service where provision of services would, in our opinion, negatively affect the workplace rights, safety or well-being of our Staff or Clients, or cause an unreasonable disruption to our normal operations. This includes any issues of abuse or disrespect (whether emotionally or physically) by client towards any of the Boudoir By J Anderson staff members. If this happens, then Boudoir By J Anderson Gift Card will be forfeited and withdrawn from client use, and client will not hold Boudoir By J Anderson, its staff members, and/or heirs liable in any way for amount of Boudoir By J Anderson Gift Card. If you are refused services due to issues stated above, you then forfeit any rights to the Boudoir By J Anderson Gift Card, photography session, and/or printed products.
11. LIMITATION OF LIABILITY. FOR SOME CONSUMERS CERTAIN OF THE FOLLOWING WARRANTY EXCLUSIONS DO NOT APPLY. CARD COMPANIES AND THEIR AFFILIATES MAKE NO WARRANTIES OR CONDITIONS, EXPRESS OR IMPLIED, OR COLLATERAL WITH RESPECT TO BOUDOIR BY J ANDERSON GIFT CARDS, INCLUDING, WITHOUT LIMITATION (EXCEPT IN QUEBEC), ANY EXPRESS OR IMPLIED WARRANTY OR CONDITIONS OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR OR GENERAL PURPOSE. IN THE EVENT THAT A BOUDOIR BY J ANDERSON GIFT CARD IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, SHALL BE THE REPLACEMENT OF SUCH GIFT CARD. CERTAIN STATE AND PROVINCIAL LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES AND CONDITIONS OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU.
12. CHOICE OF LAW. The laws of the State of Arizona, without regard to principles of conflict of laws, apply to this Agreement and use of Boudoir By J Anderson Gift Cards.
13. CHANGES TO AGREEMENT. Square and/or Boudoir By J Anderson reserves the right to change this Agreement from time to time in their discretion, which changes may be provided to you by any reasonable means.
14. FRAUD. Square and/or Boudoir By J Anderson reserves the right to refuse to honor a Boudoir By J Anderson Gift Card which, in their sole opinion, was obtained fraudulently.
15. LANGUAGE. You have expressly requested that this Agreement and all related documents, including notices, be in the English language.
